$2.2 Million Payout
Our client was crossing the lake on his snowmobile when he struck a pressure crack on the ice. He was thrown off his snowmobile and landed on his back, suffering a burst fracture to his L1 vertebrae. Unfortunately, he suffered from Cauda Equina and resulting paraplegia.
His insurer paid accident benefits to him, however, a dispute arose as to the amount of benefits the insurer ought to pay. We took the position that the insurer had to pay for home modifications in the amount of $450,000 to make our client’s home wheelchair accessible.
After suing the insurance company for breach of contract and punitive damages, we were able to settle the case at mediation. Our client structured a portion of his settlement. Including past benefits paid to him, our client will receive a guaranteed payout of over $2.2 million from his accident benefits insurer.
