The Case
Our client’s husband was a 46-year-old long-distance truck driver who was taking a break at a rest stop in West Virginia when a serious motor vehicle collision occurred nearby. Heavy rain had caused several vehicles to hydroplane and crash into the ditch alongside the highway. While he was rendering aid to the accident victims, a third vehicle lost control, left the highway, and struck him, killing him instantly along with another bystander. He was survived by his wife and young daughter.
Although the collision occurred in West Virginia, we were able to commence an action in Ontario against our client’s own automobile insurer pursuant to the Underinsured Motorist Coverage provisions of the policy. The driver responsible for the collision was an American citizen whose automobile insurance policy carried limits of $50,000 USD. We successfully resolved the claim with the American insurer for its policy limits before commencing an action in Ontario against our client’s insurer for the balance of the family’s damages. The family’s claims were ultimately resolved for $1,500,000.
Why It Matters
This case demonstrates that an Ontario family may have legal options even when a fatal motor vehicle collision occurs outside Canada. It also highlights the importance of Underinsured Motorist Coverage when the at-fault driver’s insurance policy limits are insufficient to fully compensate those affected by a serious or fatal collision. By pursuing claims in both jurisdictions, we were able to obtain compensation for the family following this tragic loss.
