The Case
Our client was driving to work when another driver crossed the centre line and struck her vehicle head-on at highway speed. As a result of the collision, she suffered orthopedic injuries, internal injuries, facial fractures, and a mild complicated traumatic brain injury (TBI). She spent twenty days at Sunnybrook Hospital for trauma care before being transferred to Ross Memorial Hospital and later discharged to inpatient rehabilitation.
Following medical assessments that we arranged, her Accident Benefits insurer agreed that she had sustained a Catastrophic Impairment as defined in her automobile insurance policy. As a result, she became entitled to $1 million in medical, rehabilitation, and attendant care benefits, together with housekeeping benefits of $100 per week. Because she was unable to return to work and required ongoing medical, rehabilitation, and Personal Support Worker (PSW) services, her insurer also funded $559,297.00 in home renovations to make her residence fully accessible. We successfully resolved her tort claim for $1,750,000, and she continues to receive income replacement, housekeeping, and medical and rehabilitation benefits through her Accident Benefits insurer. The settlement was reached in June 2026.
Why This Case Matters
This case demonstrates how a catastrophic motor vehicle collision can affect nearly every aspect of a person’s life, from employment and mobility to ongoing medical care and home accessibility. It also illustrates the significant role that catastrophic impairment determinations can play in Ontario Accident Benefits claims by providing access to enhanced medical, rehabilitation, attendant care, and housekeeping benefits. In this case, those benefits included substantial funding to renovate the client’s home to meet her accessibility needs, in addition to ongoing financial and rehabilitation support following resolution of the tort claim.
