    Woman Catastrophically Injured in Head On Crash with Husband

    Our client was a 55 year-old personal support worker who lived in a rural area. She was on her way to work and was travelling on the same windy, hilly and narrow road that she had travelled every day. At the same time, her husband was on his way home. As they both approached a hill in the roadway, our client’s husband entered our client’s lane and struck her head-on. As a result of the collision, our client suffered serious orthopedic injuries and a traumatic brain injury. She was left with significant permanent injuries and functional limitations. She was unable to walk independently, requiring a wheelchair, walker or cane. She also required constant supervision and was unable to be left alone. We sued the husband and the municipality responsible for maintaining the road. We discovered that the road had deficient sightlines (meaning approaching drivers could not see one another from an appropriate distance) and it should have been marked by a centerline. Had the roadway been appropriately marked by a centerline, the collision likely would not have occurred. The case settled during the course of trial. Our client received more than 3.75 million dollars to compensate her for her pain and suffering, loss of income and the cost of her future care, which was significant.
