$5 Million Settlement
Our young female client suffered a severe brain injury when she lost control of the vehicle she was driving on black ice. This was a single vehicle collision with no other driver to sue.
After investigating we discovered that the road had not been treated with salt or sand in spite of warnings of freezing rain and despite multiple motor vehicle collisions on the night of our client’s injury. When we sued the municipality responsible for treating the road we discovered that it had a policy not to treat its roads at night regardless of how hazardous they were.
The municipality tried to defend this policy as being reasonable. We were able to rebut their argument by hiring experts with significant experience in winter road maintenance. The case settled before trial for $5,000,000, the limit of the municipal insurance policy. This money made a huge difference to our client’s quality of life.
