$1.3 Million Settlement
Our client was a 20 year-old man who was a passenger in a car being driven by a drunk driver who did not have a valid insurance policy to respond to the claim. The drunk driver lost control of the car and it hit a pole. Our client suffered a significant brain injury. While he was able to return to school and work he needed considerable care and support.
Because the defendant did not have valid insurance we sued our client’s own insurance company. Our client’s insurance policy (like almost all Ontario policies) contained a provision that obliges the insurer to pay for damages caused by the negligence of an uninsured driver. As a result, our client was able to recover $1,300,000 in compensation despite the fact that the driver at fault for the collision did not have valid insurance.
