$2.3 Million Settlement
Our client, a single mother in her 30’s, was a helmeted passenger on an ATV when the driver lost control. She was thrown from the ATV and hit a tree with her face. The crash caused her to suffer a spinal cord injury and a traumatic brain injury. The client was left permanently unemployable and requiring substantial daily assistance with her activities of daily living. The driver of the ATV was uninsured.
Oatley Vigmond sued the clients own insurance company pursuant to her uninsured motorist coverage and assisted with a claim for catastrophic level statutory accident benefits. Oatley Vigmond assisted the client in assembling a rehabilitation team and in obtaining substantial ongoing attendant care, income replacement and housekeeping and home maintenance benefits. The accident benefits claim and the lawsuit settled together for $2,300,000.
