Rochon v Sticky Fingers
This case went to trial before a jury with Justice John McCarthy presiding. Our client Joey Rochon was returning home from a bar on foot at about 2 in the morning. He was struck by a motorist who did not remain at the scene and who was identified by the police weeks after the event. Joey lay in the snow at the side of the road, in a coma, for over 5 hours after being struck. The driver who struck Joey was not insured so we sued Joey’s insurer, which responded to the action in the place of the uninsured driver. We also sued the restaurant where the uninsured driver had been before striking Joey. Witnesses identified him as being impaired.
