Nicole Gilmour was a 21 year old single mother who suffered a devastating brain injury when a vehicle in which she was a passenger smashed into a tree. The driver, who was intoxicated, was killed. An action was brought against the estate of the driver and against the tavern that served alcohol to the driver. There were challenges with damages as well as liability because before the crash Nicole suffered from a neurological condition, which the brain injury made worse. Also, Nicole and her mother Maria cared for Nicole’s son who was intellectually challenged.
