$220,000 Settlement
Our client was a 36 year-old father of two who was a red seal chef. He was a pedestrian walking along a rural road when he was struck by a car and suffered serious orthopaedic trauma to his right leg and a traumatic brain injury. He was determined to try to get back to work despite his impairments. He returned to work as a chef but ultimately found the demands of the job much too difficult due to the combination of his physical and cognitive impairments.
His long-term disability insurer refused to pay benefits, arguing that he was capable of working in some capacity. We sued the insurance company and they ultimately settled the case for $220,000, being the present value of his future long-term disability benefits. This settlement, in addition to the $1,275,000 we recovered for him in his tort and accident benefits claim, made it possible for him to focus on family and rehabilitation rather than worry about his future finances.
