Mother of Three Suffers Serious Injuries Due to Dangerous Road

$2.5 Million Settlement

Our client was a 34 year-old mother of three. She had just dropped her kids off at school. She was driving down a hill on a narrow road that was rutted and covered with ice. A school bus was approaching in the opposite direction. When our client tapped her brakes to slow down she started to fishtail and she lost control colliding head on with the school bus. She suffered fractures in her neck at C3 to C7, fractures in her back at T2 and T3, a leg fracture and a nasty fracture of her elbow and forearm. She also suffered a brain injury.

Prior to the injury she had been working as a Church administrator to support her family. Due to the combination of her impairments she could not return to work. Without compensation for her lost income her family’s future looked bleak. We sued the municipality responsible for maintaining the road and the bus driver for failing to steer right to avoid the collision.

By retaining experts with a great deal of experience in winter road maintenance we were able to establish that the road was icy because the municipality was slow to start treatment and used sand when it should have used salt. The case settled about a month before trial for $2,500,000. The settlement gave our client the peace of mind of knowing that she will be able to send her kids to university and get the treatment that she needs.
