$1.875 Million Settlement
Our 57 year old client suffered a traumatic brain injury, fractures to her face, fractures to her wrist and arm, and a large laceration to her forehead when she was ejected from a side-by-side ATV in which she was a passenger. The driver lost control and rolled the vehicle. Our client required plastic surgery to her face and two surgeries to her arm. She went on to suffer from major depressive disorder, post-traumatic stress disorder, mild neurocognitive disorder due to brain injury, chronic pain, and a sleep disorder. As a result, she never went back to work and she required significant amounts of treatment and rehabilitation.
Even though the driver did not have motor vehicle liability insurance, we were able to recover our client’s damages from her insurer under the Uninsured Motorist Coverage provisions of her own automobile insurance policy. We successfully settled her tort and accident benefit claims at mediation for $1,875,000.
