$1.6 Million Settlement
A university student was driving south on Gore Road, in Caledon. She was heading to the theatre to see a movie with her boyfriend. Unfortunately, a transport truck driver was also on Gore Road that night. He was backing his truck and trailer into his driveway. The transport truck was situated across both the northbound and southbound lanes. The truck and trailer were covered in salt and dirt, which obscured the retro-reflective strips.
The young woman had absolutely no warning of the transport truck’s presence and no time to react. She crashed into the side of the trailer at 70 km/hr. Her car was destroyed and she was trapped. She suffered an incomplete spinal cord injury and her vertebrae were fused. Consequently, she suffered from significantly reduced range of motion in her neck. She had to turn her whole body to look in a certain direction. She also suffered from constant back pain, neck pain, and headaches.
We sued the transport truck driver and the case settled prior to trial, for a total of $1,629,000.
