What If Your Doctor Makes A Mistake?
Doctors do their best to provide treatment and care to their patients. However, sometimes they make mistakes. Sometimes these mistakes can have grave consequences for their patients. As a personal injury lawyer, I have seen people who have been catastrophically injured because of mistakes made by doctors. Tragically, I have also met with people who have lost family members due to medical mistakes.
In Ontario, people who have suffered injuries because of the negligence of a doctor can sue for damages. Similarly, the family members of a person who has died due to the negligence of a doctor can sue for damages.
Not every single mistake by a doctor constitutes “negligence”. For a mistake to be negligent the doctor must be proven to have fallen below the standard of care expected from a reasonably competent doctor. Under most circumstances, you only have two years from the date of the injury to commence a lawsuit against a doctor. Therefore it is important to consult the right lawyer sooner rather than later or your right to recover compensation may be barred by the passing of the two-year limitation period.
