We have acted for countless clients who have suffered permanent injury to their knees. We are always mindful of two things where knee fractures are concerned. First of all, the claim is almost always about how the impairments from the fracture will worsen as our client ages. And second, since the knee is a critical weight bearing join and because post traumatic arthritis almost always follows a significant fracture, our client’s condition will almost always get worse with time.
We acted for a young man who worked on the line in a factory. He was fishing in a small aluminum boat when he was rammed by someone on a personal water craft. At the time of trial our client was working more overtime and making more money than he was before the crash. But we led evidence through our orthopaedic surgeon and through an animation to show the increasing destruction of the cartilage in our client’s knee. The evidence convinced the jury that our client would probably not be able to work past 50 years of age. Our client testified that he was working extra hours now, despite the pain, as a hedge against having to retire at a young age. The defence had offered a paltry sum but the jury accepted our version of the case and awarded our client sufficient funds to secure his financial future.
