Young father injured on dirt bike on private track

$1.175 Million Settlement

Our client, a young husband and father, was using a dirt bike on a private track in Ontario. He went over a feature on the course and hit the ground with great force. As a result, the young man suffered significant spinal fractures and a complete spinal cord injury in his lumbar spine. He now requires a wheelchair as well as assistance with many of his personal care activities and activities of daily living.

At first, our client’s insurance company refused to provide this young man with no-fault accident benefits coverage. The insurance company initially tried to deflect the case to another insurance company or a government fund. Once that proved unsuccessful, the insurance company alleged that there was no coverage because the dirt bike was not an “automobile” as that term is defined in the relevant legislation. We commenced a lawsuit against the insurance company and ultimately settled his claim for $1,175,000.
